T Visa

Human trafficking or trafficking in person is a huge global problem where traffickers lure unsuspecting and vulnerable individuals with promises of employment and a better life. However, on arriving at their destination, the individuals become victims of forced labor and inhumane exploitation. The U.S. is a common destination for victims of human trafficking from developing countries.

The T Visa offers immigration protection or relief to victims of human trafficking. The T nonimmigrant status allows victims to remain in the U.S. and assist law enforcement in investigating and prosecuting human trafficking cases. The law does not require the victims to be legal migrants. However, to be eligible for a T visa, the victim must:

  • Be physically present in the U.S. as a result of human trafficking.
  • Be a victim of a severe form of human trafficking, including sex and labor trafficking.
  • Be in danger of suffering extreme hardships involving unusual and severe harm if deported or removed from America.
  • Comply with reasonable request to assist law enforcement authorities in investigating and prosecuting human trafficking cases, unless they are under the age of 18.

If approved, a T Visa offers several benefits to human trafficking victims including;

  • temporary immigration status,
  • a pathway to lawful permanent resident status, and
  • permission or authorization to work.

Qualifying family members of the victim may be eligible to enjoy the benefits of a T nonimmigrant status.
